1. Welcome to Spelling Chimps!
This is an agreement between you (the parent or legal guardian) and [Company Name] ("we," "us," or "our") that governs your use of the [App Name] web application and related services. By letting your child use the App, you agree to these terms.
2. Who Can Use the App
Parents/Guardians: You must be at least 18 years old and legally able to agree to these terms.
Kids: The App is designed for elementary school children to use under the supervision of a parent or guardian.
Teachers: The App is designed for you to publish word lists that will become PUBLICLY available. Your name and your word lists will be accessible to ANYONE that visits the App.
Your Consent is Key: By using the app, you confirm that you, the child's parent or legal guardian consent to our Privacy Policy. You agree to supervise your child's use of the App.
3. Your Account and Responsibilities
Account Security (teachers only): You are responsible for keeping your account login information private and secure.
4. Rules for Use
We want the App to be a safe, positive, and educational space.
Teachers: If you are using the App as a teacher or educator to create and share custom content (such as spelling lists, quizzes, tests, assignments, etc..), you agree that: (1) Content Must Be Educational: All shared content must be appropriate for children and strictly related to educational purposes; (2) No Student PII: You must never include or require students to submit any personally identifiable information (PII) beyond what is strictly necessary to identify them within the class roster (e.g., first name or student ID); (3) Supervision and Consent: You confirm that you have obtained all necessary parental consent required by your school or district policies for students to use the App and for you to publish content for their use.
Parents and children: The App does NOT provide a mechanism for you to share any personally identifiable information (like names, addresses, phone numbers, etc..).
ALL users: DO NOT steal our work. No one is allowed to copy, sell, or distribute any part of the App, its content, or code without our permission. All content is owned by us.
ALL users: DO NOT use the App to transmit viruses or attempt to gain unauthorized access to ours or third-party systems.

We Take Privacy Seriously. Protecting your privacy is our top priority.
Please Read the Privacy Policy: This ToS is tied to our Privacy Policy, which explains exactly what information we collect from teachers, how we use it, and your rights. You must agree to the Privacy Policy to use the App.
6. Changes to the ToS
We may update these terms from time to time. We will notify you of any material changes by posting the new ToS on the App and/or sending you an email. Your continued use of the App after the changes means you accept the new terms.

Privacy Policy (Teachers)

1. Overview
This Privacy Policy explains how Spelling Chimps (“we”, “us”, “our”) collects, uses, and protects information about teachers who use the application. We do not create accounts for students, and we do not collect personally identifiable information (PII) about students.
2. Information We Collect About Teachers
When a teacher registers or logs in, we may collect:
Account Information: Name (if provided), email address (required for account creation and login), and encrypted password or authentication data (managed by our authentication provider).
Classroom & Usage Information: School and class identifiers (for example, school name and class name), configuration and settings you choose (such as word lists and game settings), and activity logs related to your teaching use (for example, list publishing and dashboard views).
3. Students and Children’s Privacy
Students use the app anonymously through school and class selections configured by their teacher.
We do not ask students for names, email addresses, or any other personal identifiers.
Any performance or progress data is associated with classes or word lists, not with individually identifiable students.
4. How We Use Teacher Information
We use teacher information to:
Create and manage teacher accounts and authentication; provide access to dashboards, word lists, and game settings; support classroom management and progress tracking at the class or group level; maintain the security and integrity of the application; and improve features, performance, and reliability of the service.
We do not sell teacher information to third parties.
5. Data Storage and Security
Teacher account data is stored in secure, access-controlled databases. Passwords and authentication tokens are handled using industry-standard security practices.
We apply reasonable technical and organizational measures to protect teacher information from unauthorized access, disclosure, or misuse.
6. Sharing of Teacher Information
We may share teacher information only with trusted service providers (such as hosting, authentication, or analytics providers) who help us operate the app and who are contractually obligated to protect the data; if required by law or legal process; or in connection with a business transaction (such as a merger or acquisition), subject to continued protection of the data.
We do not share student PII because we do not collect student PII.
7. Data Retention
We retain teacher account data for as long as the account is active or as needed to provide the service.
Teachers may request deletion of their account; upon deletion, we will remove or anonymize teacher data within a reasonable period, subject to legal obligations.
8. Your Choices and Rights (Teachers)
Teachers may update account details (such as email) via the app where supported or by contacting us; request access to, correction of, or deletion of their account information, subject to verification; and opt out of non-essential communications where applicable.
9. Changes to This Policy
We may update this Privacy Policy from time to time. When we do, we will change the “Last updated” date and may provide additional notice for material changes. Continued use of the app after changes are posted means you accept the updated policy.
